Ridge Mine (C-84-065) <br />Dear Mr. Matthies: <br />Public notice of NCIG's application for TR-09 was published in the <br />Glenwood Post on September 11, 1991. A complete copy of the <br />application should have been filed at the Garfield County Clerk and <br />Recorder's office at that time. On September 23, 1991, this office <br />received a letter from the Garfield Citizen's Alliance indicating <br />that the application was not on file with the county. A copy of <br />that letter is enclosed. The Clerk and Recorder's office <br />indicated to the Division over the phone that the revision <br />materials have not been placed at their office. <br />Rule 2.08.4(5)(b) of the Regulations of the Colorado Mined Land <br />Reclamation Board for Coal Mining requires that a public copy of <br />revision applications be filed at the same time as public notice is <br />published. Since this publication initiates the public review time <br />frames and since the public has not been able to review the <br />revision application, the Division requires that public notice of <br />TR-09 be republished. A complete copy of the revision application <br />must be on file at the Garfield County Clerk and Recorder's office <br />at the time of publication. All review and comment time frames <br />will initiate as of the new date of publication. <br />As you know, TR-09 includes modifications required by the Division <br />as a result of the adequacy review of the application to renew the <br />Coal Ridge permit, which expires on October 9, 1991. If TR-09 has <br />not been approved prior to that date, NCIG will be able to continue <br />to operate under the existing permit since the renewal application <br />was submitted in a timely manner. However, you should be aware <br />that permit renewal cannot be granted unless this revision is <br />approved. Therefore, it is in the interest of the company to file <br />the required materials and republish as soon as possible. <br />STATE OF COLORADO <br />
