Box 176 <br />Oak Creek, Colorado 80467 <br />RE: Edna Strip Mine (C-80-001) <br />Minor Revision 30 and Quarterly Sedimentation Pond Inspections <br />Dear Mr. Beverlin: <br />This letter will serve to document our discussion earlier today, regarding the above mentioned <br />minor revision. As we discussed, CDMG has two concerns with the submittal. <br />1. The application for the revision was accompanied by only one copy of the submittal, and <br />not the required three copies. Please submit the required number of copies. <br />2. The revised tenth page of Appendix 4.6-M made reference to an exemption that would <br />be granted from 1st and 4th quarter monitoring of the check dams due to winter <br />conditions. Rule 4.05.9(13) requires that the inspections be conducted, at a minimum, <br />on a quarterly basis. Due to that requirement, we cannot approve the requested <br />exemption. Please remove the reference to the exemption from the revised page. <br />In another matter, it has come to our attention that the previously granted exemption from 1st <br />and 4th quarter sediment pond inspections was inappropriate based on the requirements of <br />Rule 4.05.6(13). This rule also states that the inspections must be conducted, at a minimum, <br />on a quarterly basis.
