Stevens
Colorado Division of Minerals and Geology
Department of Natural Resources
1313 Sherman Street, Room 215
Denver, Colorado 80203
Dear Mr. Stevens:
Reference is made to your letter dated October 30, 1996
regarding the proposed sand and gravel mining in Lyle Smith Pit
near Fort Garland, Costilla County, Colorado. (Action No. 1996
30454)
we have studied the project description, other records, and
documents available to us. The project is not regulated under
the provisions of Section 404 of the Clean Water Act and a
Department of the Army permit will not be required. This
determination was made because the subject mining site does not
contain waters of the United States.
Should you have any questions, please feel free to write or
call Madeline M. Santos at (719) 543-9459.
Sincerely,
-James M. Townsend
Chief, Southern Colorado
Project Office
///
ero kci&nM
sro rolernna
///
