The application also addresses changing the seed mix and the <br />mulch materials. <br />In our phone conversation of November 20, 1995 you indicated that the highwall would be <br />backfilled using available overburden which is primarily located above the highwall at the north end <br />of the permit boundary, as are the topsoil stockpiles. This will result in highwall backfill partially by <br />cut and fill methods and partially by dozing stockpiled overburden over the highwall. You also <br />indicated that t:he landowner adjacent to, and uphill from the pit would allow you to remove <br />overburden from his property to use for backfill, while this landowner would benefit by his property <br />being leveled for a home site. <br />Please be aware that a letter from the landowner, indicating this agreement would be advisable <br />before disturbing that property. In the absence of that agreement, the excavation may be viewed <br />as mining outside your permit boundary. Also, be aware that none of the material from that <br />property could tie sold, as this would be viewed as mining outside your permit boundary. <br />Your application for technical revision has been approved and the resulting revised reclamation bond <br />estimate is enclosed. Neil's Excavation must submit adequate financial warranty in the amount <br />indicated in the enclosed bond recalculation within sixty davs of the receipt of this letter. <br />Please review ttte enclosed figures and contact our office as soon as possible if you feel any of the <br />calculations are in error. It is important to point out that the enclosed estimate is based on a bond <br />forfeiture scenario where the permit has been revoked and the division must hire an independent <br />contractor to complete all remaining reclamation activities at the site as provided for in the approved <br />reclamation plan. <br />
