Our initial review indicates that all preliminary items required by Rule 2.08.5(4) have not <br />been submitted. Thus, your application is incomplete for the purposes of filing as of May 28, 1996. <br />You noted in the cover letter that P&M had not yet obtained a letter from the landowner granting <br />permission to retain roads proposed as permanent in the revision application. Rule 2.08.4(5)(d) <br />requires that a revision application include information necessary for the Division to determine if the <br />proposed revision will comply with the Colorado Surface Coal Mining Reclamation Act (Act) and the <br />Rules and Regulations of the Colorado Mined Land Reclamation Board for Coal Mining (Rules). In <br />order to determine that retention of the roads is in compliance with Rules 4.03.1(1)(f)(ii) and <br />4.03.2(1)(g)(ii), we are in need of a written request for retention from the landowner. In accordance <br />with Rule 2.07.3(1), you have the opportunity [o amend, review, or otherwise make your application <br />complete.
