Work continues <br />to complete the request tasks. Delays in responding to this request were primarily due to the <br />recent transfer of permitting files and softwaze from WFA to BME. Though requested from <br />WFA earlier, these items did not arrive until about November 1 making a timely, comprehensive, <br />and accurate submittal difficult. Therefore, we request an extension to January 15, 2001 to <br />submit the remaining information. <br />Initial response to Order to Revise Permit: <br />1.) Mapping of disturbed area. <br />We are currently working on completing this project. An amended Map 138 or additional <br />map or maps, as warranted, will be provided with our second submission. <br />Perimeter Markers. <br />Rule 4.02.3 requires marking of the perimeter's of all areas affected by surface operations or <br />facilities...before [he beginning of surface coal mining operations. This rule is intended to <br />avoid additional disturbance or unnecessary disturbance beyond that approved. Once the <br />facilities are constructed or the perimeter is disturbed, serving as the perimeter marker in <br />itself, there is no need or requirement to maintain additional markers. At this stage the <br />disturbance itself serves as adequate and appropriate bounds for disturbance. Prior to the <br />initiation of land disturbing activities, and typically as part of the permit approval process, <br />facilities (perimeters of disturbance) are mazked/staked. These markers are maintained until <br />such time that the land disturbing activities have progressed to a point that no additional <br />surface disturbance will take place for construction. <br />2.) Table V-3 will be revised as necessary to include areas that may have been inadvertently lefr <br />out. Reference to County Road 65 has been removed. The revised Table V-3 will be <br />included with the second submission since refinements may arise during the delineation of <br />the disturbed areas. <br />3.)
