Aggregate Source - 112 Amendment, <br />Permit No. M-77-193 <br />Dear Mr. Klco: <br /> <br />.~-~ <br />~~ . <br />~ ~ ,~5 <br />~]~~~~~ ~ <br />~ $,~ <br />P.eview <br />I have completed my review of the permit amendment application for <br />the Tezak Aggregate Source quarry which proposes an increeise in the <br />size of the permitted area from 30 to 65 acres. Because of the <br />nature of public concerns already expressed and the close proximity <br />of the operation to public and private dwellings, I am extending <br />the decision date of the amendment application to October 8, 1995 <br />in conformance with Rule 1.4.1(7) of the Mineral Rules & <br />Regulations. Copies of the comments received were made available <br />to you on July 7, 1995 following the site inspection. <br />The Division will follow the procedures listed below in order to <br />comply with the public review process provided in the Mineral Rules <br />& Regulations: 1) a pre-hearing conference officer will be selected <br />at the July 26-27 Board Meeting, 2) a pre-hearing conference will <br />be scheduled in Canon City in August prior to the monthly Board <br />Meeting, 3) a Formal Public Hearing will be scheduled for the <br />August 23-24 Board Meeting for consideration of the amendment <br />application, 4) a decision on the application will be made at the <br />August 23-24 Board Meeting or as soon as possible thereafter. <br />The adequacy concerns listed below should be addressed and resolved <br />if possible by no later than 5:00 P.M. August 18, 1995. <br />1. The operator (THECI) will need to provide a written a~34reement <br />with the owner of any structure within 200 feet of the disturbed <br />area, such as the Rencher Concrete manufacturing building, that any <br />damages resulting from mining will either be repaired or <br />compensated for. <br />2. The mining plan specifies that blasting will be cond~icted. A <br />primary concern with the application is that the operator (THECI) <br />will be able to ensure that nearby structures such as i:he water <br />filtration plant and residential homes will not be ~idversely <br />affected by blasting. We recommend that the operator ~~ropose a <br />monitoring program to ensure that all blasting is within a~~ceptable <br />limits and to provide a schedule of acceptable times during the day <br />and week when blasting is conducted. Further, we recommend that <br />the operator designate an employee to be responsible for notifying <br />
