All of the <br />Division's questions have been answered except for one new issue and the previous issue, <br />membered #10 and #11 in your March I, 1999 letter to Seneca, involving the Lehman Brothers <br />entities. <br />The AVS shows that the "CO Investment Partn",AVS ID ] 46584, has been recently <br />entered as a shareholder of P&L Coal Holdings. This entity addition now means that <br />there are five shareholders of P&L Coal Holdings listed in AVS. However, "CO <br />Investment Partn" does not appear in the list of officers and directors for P&L Coal <br />Holdings, the percent ownership of shares is not documented, the shareholder entity does <br />not appear in the organizational chart above P&L Coal Holdings, nor is there a list of <br />officers and directors. If "CO Investment Partn" is a shareholder of 10 percent or more <br />of P&L Coal Holdings, please submit this information. <br />However, if the AVS situation involving the "CO Investment Partn" is similar to the <br />AVS issue involving the four Lehman Brothers entity shareholders of~P&L Coal <br />Holdings, then please contact the Office of Surface Mining and resolve this issue with <br />[hem. <br />2. The Division is waiting for a decision from OSM as to the resolution of the issue <br />involving the four Lehman Brothers entities and P&L Coal Holdings. This issue was <br />stated in questions numbered 10 and 11 in the Division's letter to Seneca dated March 1, <br />1999.
