This <br />transmittal letter and attachments are designed to address the applicable Mine Safety and Health <br />Administration (MSHA) information and plan requirements under 30CFR 77.215 and 77.216, for <br />refuse piles and sediment impoundments, respectively. OMLLC currently places this <br />material as designed fill benches in the West Valley Coal Refuse Facility, located in a small ephemeral <br />Odrainage immediately to the west of the OMLLC mine surface facilities, as shown on the Facilities <br />Map, (Map 1). With recent development of the Elk Creek Mine, the quantities of mine development <br />waste have exceeded OMLLC's original projections, with the result that the volume of material that <br />has been placed in the existing West Valley Coal Refuse Facility is rapidly approaching its design <br />capacity. In order to address current and future operational requirements for disposal of coal refuse <br />and non-coal processing waste material in a safe and environmentally compatible manner; OMLLC <br />urgent]}~ needs to permit and develop a new coal refuse disposal facility. <br />P.0.
