Installation of the conveyor and pipe crossing over the Fulton Ditch shall require <br />DMG approval of a written agreement with the Futton Irrigating Ditch Company. Prior to <br />mining be Ing undertaken In any area, excavate on setbacks w II be staked In the field to <br />ensure relevant setbacks are followed. <br />2. The existing wetlands area as shown on this map shall not be disturbed until a <br />wetlands Inventory Is accepted by the Corp of Engineers and a 404 permit Is Issued <br />allowing removal of any jur i sdectI onal wetlands requiring the appropr l ate 404 perm t. Site mining above the lake elevation level will use dry mining techniques using <br />backhoes, bulldozers, and s miear equipment. Below the water level, drag lines, backhoes, <br />and /or dredges shall be employed for mining, <br />4. Topsoil and overburden stockpiles that are temporarily stored on site In the S. <br />Platte River floodplaln area shall be in an alignment parallel to the overF.low direction <br />of the S. Platte River, have a max l mum he I ght of 30', a maximum base width of 100', a <br />maximum length of 300', maxilmum IHi IV slopes, and have a minimum of spacing of 100' <br />between different stockpiles. A Floodplaln Use Permit from Adams County shall be obtained <br />for all operations within the 100 year floodplaln. Topsoil and overburden stockpiles <br />proposed for final reclamation activities shall be placed out of the 100 year floodplaln <br />in the northeast and southeast corners of the site. Operations on site shall also Include <br />the installation of a conveyor and wash pipe crossing of the Fulton Ditch, and the <br />Installation of temporary conveyors and Internal roadways as needed. <br />6. Excavated material shall be transported off -site to the existing Plant Site by <br />conveyor, except by approval of Adams County for borrow material which may be transported <br />off -site by truck via the site's existing entrance onto Brighton Road. <br />7, Mining w111 Involve the striping and storage of topsoil and overburden, temporary <br />excavation to a vertical condition (.51H, IV), that will Immediately be temporarily <br />backfl tied to at least 1Hi IV, slopes if expected to remain for less than 1 year. <br />Stockpiles expected to remain longer than 1 year shalt be sloped to at least 3", IV and <br />temporary ly revegetated. Areas below the water level will be backFllied with sand spot is, <br />excess overburden, and silt from process water from the processing plant that Is Located <br />on another portion of the permit area. All final slopes shall be a maximum .steepness of <br />3W 1V, and then a minimum of 6' of topsoil shall be placed on all reconstructed areas <br />above the existing lake water level. <br />8. Per the Noxious Weed Control Plan In EXHIBIT D - MINING PLAN, noxious weeds will be <br />controlled, particularly Diffuse Knapweed, Scotch Thistle, and Canada Thistle, which have <br />been observed within the permit area and on adjacent property. ALL areas adjacent to <br />roadways and waterways will be assessed every spring to determine the best management <br />practice for weed control. At a minimum, all noxious weed areas will be mowed as needed. <br />In heavily Invested areas, approved herbicides will be applied as needed to include, but <br />not limited to, Tordon 22K applied at 1 pt /ac at 20 gpa or 2,4 -D 44 amine at I qt /ac at <br />20 gpa. Consultation with qualified vegetation managers and /or county weed control <br />coordI nators will be on -go l ng to assist In the management of noxious weeds. <br />9. No partial dewatering shall be undertaken without agreement with shallow well owners <br />within 600', or approval of the State Engineer's Office <br />11.
