P.E. <br />State Engineer <br />Mr. Joseph Dudash <br />Environmental Protection Specialist <br />Division of Minerals and Geology <br />1313 Sherman Street, Room 215 <br />Denver, Colorado 80203 <br />RE: Bowie Mine #1 (Permit C-1981-038) <br />Technical Revision Application # 37(TR-37) <br />Dear Mr. Dudash: <br />The Division of Water Resources has reviewed the notice and description of the referenced <br />Technical Revision TR-37 with regard to impacts on water resources and water rights. <br />The proposed Technical Revision involves replacing an existing sediment pond with 1.3 <br />acre-feet capacity with two ponds of 0.6 and 0.9 acre-feet capacity. <br />The mine site is located within the drainage of the North Fork of the Gunnison River which, <br />with all its tributaries, is critical. This critical condition means that this drainage is <br />overappropriated. <br />Accordingly, the proposed revision should be limited to: <br />a) Storing no more than the original 1.3 acre-feet volume. <br />b) Maintaining a storage level such that the surface exposure to evaporation does not <br />exceed the original area of the 1.3 acre-feet pond. <br />If you have additional questions or need clarification, please contact me. <br />~~ <br />Sincer <br />Chuck Roberts <br />Professional Engineer III <br />CGR:jmg <br />W200L.cgr <br />
