Lachhead E aecuove Dueaa Michael B Wog Drvmon Director The Division of Minerals and Geology hereby issues notice, in accordance with Tile 34, Article 33, Section l 16, Paragraph 4, of the Colorado Revised Statutes, that on December 24, 1998, an application to revise coal mining operations at the Bowie Mitre No. 1 was considered complete for the purposes of filing. The. revision was submitted by Bowie Resources Limited. All review and comment periods as provided in the Act and [he Regula[ions initiate from this date of filing. Approval of this Technical Revision would allow for an increase in the annual production at the Bowie No. 1 Mine train loadout from the current maximum permitted amount of 1.7 million tons to a maximum of 4 million tons. The increase will come in increments with a projected production of 2.75 million tons in 1999 and 4 million tons in 2000. No new land will be disturbed. There will not be any changes to the facilities or to the hydrologic protection system. There will be an increase in the water consumptive use at the loadout but the water consumptive use overall had been lowered when the mine itself was idled. The underground coal mining operation is on land located approximazely 3 miles north of Paonia, Colorado. The permi[ area is further described as follows: Portions of Sections 1, 2, 3, 10-15, 22-25, Township l3 South, Range 92 West of the 6th P.M. Portions of Sections 5-8, 17-19, 29-32, Township 13 South, Range 91 West of the 6th P.M. The above-mentioned tracts of land are shown on USGS 7.5 minute Quadrangle map of Bowie. Because [he above referenced technical revision application would incorporate additional lands into the permit area or migh[ otherwise alter previously approved permit conditions or mitigation measures, we are requesting your agency's evaluation of the proposal. Your comments and concerns relating to the adequacy of fish and wildlife resources information, the fish and wildlife plan, and the reclama[ion plan as it relates to fish and wildlife considerations, including potential impacts [o threatened or endangered species, are requested. If wildlife habitat is the proposed postmining land use, we request your evaluation of proposed woody plant stocking levels, planting arrangements, and methods for mitigation of potential adverse impacts.
