Long, <br />Division Director <br />On June 29, 1992 the Colorado Mined Land Reclamation Board conditionally <br />approved the technical revision application submitted to the Division on May <br />29, 1992, addressing the reevaluation of the apprcved ~;:;yram fcr ground water <br />monitoring, sampling and analysis at the Sdn Luis Project tailings structure. <br />This technical revision was submitted in partial satisfaction of Abatement <br />Requirement #8, placed upon the March 31, 1992 Notice of Violation. The terms <br />of TR No. 008 approved by the Board are hereby incorporated into Permit No. <br />M-88-112. <br />As proposed in TR No. 008, Battle Mountain Resources, Inc. (BMRI) will <br />evaluate the results of its enhanced groundwater monitoring program dnd assess <br />whether the monitoring well network is adequate for its identified fWnctions. <br />Further, BMRI proposes to provide the Division with the results of its <br />evaluation. In the event that BMR determines that the well network is <br />inadequate, BMRI commits to proposing additional well locations to the <br />Division. <br />In approving TR No. 008, the Board places the foliowinq condition uppn BMRI. <br />If the Division disagrees with BMRI's evaluation, BMRI will install additional <br />monitoring wells and complete additional evaluations, as directed by the <br />Division, <br />As ordered by the Board on June 25th, 1992 (see attached), this approval <br />triggers the compliance deadlines contained in paragraph (3) of the Board's <br />additional corrective action order. <br />If you have any questions, please contact me. <br />Sincerely, <br />J i <br />.• - - <br />H.
