This permit was <br />originally issued for the West Elk Mine in July 1981, renewed in August, 1985, January 1993, <br />(effective 1991), and July 31, 1996. The five-year permit term expires July 31, 2001. <br />Included with the application form is a proposed public notice. Once the notice has been <br />published and MCC has received proof of publication, a new Figure 2 will be provided to the <br />Division which should replace Figure 2, currently in the permit at page 2.03-10. <br />A renewed liability insurance policy was previously provided to the Division and a copy is <br />provided with this renewal application. The renewed certificate should replace the certificate <br />currently in Volume 2, Exhibit 5. Although the Division requests that the evidence of insurance <br />be provided for the proposed period of renewal (5-years), the insurance industry does not issue <br />certificates for generally longer than one year increments. MCC will provide the Division with <br />certificates on an annual basis. <br />Due to the extensive mid-term review, (TR-90) and MCC's responses to the Division's <br />comments and questions, few changes aze presently proposed. There are two outstanding issues <br />regazding the present permitting status, they are, Permit Revision No. 9 (PR-09), a request by <br />MCC to construct coal handling facilities in Sylvester Gulch and Minor Revision No. 270 (MR- <br />270) which is a request for ongoing activities associated with a "thetmal event" that occurred in <br />January 2000. "The permit volumes currently on file at the Division's office are incorporated by <br />reference with this renewal application. The pefmitted acreage was revised to reflect PR-08 (Box <br />Canyon) and the associated addition of Federal Lease COC-56447, (Box Canyon). A table <br />showing the changes is also included with this submittal. <br />
