Crosby: <br />We have completed our review of TR 36, Auger Area #2. Please note that <br />Colowyo submitted the TR to the BLM ae number 35, not number 36 as shown on <br />your letter. We have no objection to this mine plan modification and <br />recommend approval. <br />Any revision that affects the recovery of the federal coal resource requires <br />approval by the BLM. While we can certainly appreciate the constraints of <br />regulatory timeframea, a lack of response must not be taken as an approval for <br />this type of revision. In this particular case Colowyo provided the BLM with <br />an advance copy of their proposal and met with us in order to resolve any <br />problems we might have and speed the process. As you are aware, each company <br />hand lea its permitting differently and in some cases they will not have <br />notified the BLM and there may be additional delays. We are also concerned <br />that lost, delayed, or misrouted correspondence would result in an implied <br />approval. For example, your letter of February 14, 1996 concerning TR 36 <br />arrived in our office February 20, 1996 at 11:24 a.m. This is normal delivery <br />service from Denver but leaves us only 9 days to complete our review, reply, <br />and have it delivered to you. We would ask that the DMG be aware that for <br />revisions where the federal coal resource ie affected, a fifteen (16) day <br />turnaround may not be possible and that no implied approval should be assumed <br />from a lack of response. <br />If you have any additional questions, please contact Jerry Strahan at (970) <br />824-4441. <br />Sincerely, <br />John E.
