Gzttany <br />Division Director <br />Natural Resource Trustee <br />The Division has completed a review of your June 9, 2006 TR-15 adequacy review <br />response. Our itemized comments regarding the concerns addressed in that submittal are <br />listed in Enclosure 1. Note that we have only one remaining adequacy request (Item <br />19a). Upon submittal of amended text in response to this item, we will proceed with <br />issuance of proposed approval decisions for TR-15 and RN-6. <br />You correctly pointed out a duplication of tasks in the reclamation cost estimate (Item <br />14). We have updated Task 041 of the TR-15 Cost Estimate to reflect a reduction in the <br />demolition cost of $193.30. See Enclosure 3, TR-IS Cost Estimate Revision. <br />A June 16, 2006 comment memorandum from USFWS regarding the recent Biological <br />Assessment Analysis prepared by OSM, for the McClane and Munger operations, is <br />provided as Enclosure 2. OSM had requested USFWS concurrence regarding "no effect" <br />findings for the Mexican spotted owl, Canada lynx, Uinta basin hookless cactus, <br />DeBeque phacelia, and Parachute penstemon, and "may affect but not likely to adversely <br />affect" findings for the bald eagle and yellow billed cuckoo. The USFWS memorandum <br />does indicate concurrence with the OSM findings. In addition, OSM had requested <br />formal Section 7 consultation with USFWS regarding the potential effects of the <br />McClane and Munger operations on the endangered fish species of the upper Colorado <br />River, associated with mine related water depletions to the upper Colorado.
