Also, at that time, a portion of the civil penalty was ordered held in abeyance. Staff said the operator's application for a 110(2) permit was received on July 8, 1992 and deemed complete on July 17, 1992. the operator submitted a financial warranty in the form of a $5,000 Certificate of Deposit on July 26, 1992, and the performance warranty was submitted on August 26, 1992. The operator remitted the $1,000 civil payment on June 29, 1992. Staff also discussed the reclamation work the operator had completed at the site. Staff recommended that the Board suspend a significant portion of the $6,800 civil penalty which had been held in abeyance. In response to a question from the Board, Staff said the Division does have a reclamation plan that includes grading of the pit's side slopes, topsoiling and revegetation. The final land use is for a livestock feeding pen. Staff said it would cost about $5,000 to reclaim this site. Mr. Jack Gilleland, the operator, discussed this matter briefly with the Board and showed pictures, EXHIBIT B, of the work he said had been completed at the site since the May 1992 Board Meeting. It was MOVED that the Board find that, in review of the information presented, it appears that proper corrective actions have been taken, that the bond is sufficient to assure final site reclamat on and that the Board suspend the remainder of the civil penalty related to this matter.
