Also, at that time, a portion of the civil penalty was ordered <br />held in abeyance. <br />Staff said the operator's application for a 110(2) permit was received <br />on July 8, 1992 and deemed complete on July 17, 1992. the operator <br />submitted a financial warranty in the form of a $5,000 Certificate of <br />Deposit on July 26, 1992, and the performance warranty was submitted on <br />August 26, 1992. The operator remitted the $1,000 civil payment on <br />June 29, 1992. Staff also discussed the reclamation work the operator <br />had completed at the site. <br />Staff recommended that the Board suspend a significant portion of the <br />$6,800 civil penalty which had been held in abeyance. <br />In response to a question from the Board, Staff said the Division does <br />have a reclamation plan that includes grading of the pit's side slopes, <br />topsoiling and revegetation. The final land use is for a livestock <br />feeding pen. Staff said it would cost about $5,000 to reclaim this <br />site. <br />Mr. Jack Gilleland, the operator, discussed this matter briefly with <br />the Board and showed pictures, EXHIBIT B, of the work he said had been <br />completed at the site since the May 1992 Board Meeting. <br />It was MOVED that the Board find that, in review of the information <br />presented, it appears that proper corrective actions have been taken, <br />that the bond is sufficient to assure final site reclamat on and that <br />the Board suspend the remainder of the civil penalty related to this <br />matter. SECONDED AND PASSED 6 for (Kraeger-Rovey, Jouflas, Stewart, <br />Danielson, Danni and McCannon); 1 abstention (Cooley). <br />28. FORMAL PUBLIC HEARING <br />BATTLE MOUNTAIN RESOURCES, INCORPORATED File No. M-88-112 <br />333 Clay Street, 42nd Floor <br />Houston, TX 77002 <br />All persons wishing to give testimony were sworn. <br />Secs. 15, 16, 17, 20, 21 and 22, T32S, R71W, 6th P.M., Costilla County, <br />2,200 acres; 112 open pit gold and silver. Status report on progress <br />towards completion of 12 Board ordered corrective actions, as amended, <br />and status of reducing the cyanide concentrations of waste stream and <br />waste disposal areas to levels that comply with the permit (continued <br />from the July 1992 Board Meeting. <br />The Chairman clarified that the official record of these proceedings <br />was being established by the Division. <br />Staff presented EXHIBIT A, a package of information includ'ng a status <br />report regarding the activities that have taken place at this site <br />since the July 1992 Board Meeting; each abatement requirement was <br />briefly discussed. <br />
