When we told him we were not interested, Mr.
Glass accused us of taking water that he owned. We met with Mr. Glass and his reed estate
agents in the field, and reviewed the information with our attorney and water consult+mts. The
following documents are enclosed as additions to the Technical Revision:
Exhibit A is a copy of our response back to Mr. Glass.
Exhibit B includes copies of the court findings and decree for the I.C. Woods Seepage Ditch.
Exhibit C is a map showing the I.C. Woods Seepage Ditch in relation to our propert}•.
The solid line indicates the legal description on the 1945 decree. The entire
decreed ditch was not shown on our original submittal because it's nearest
point to our property line is over 2000' away.
The dashed line on the map indicates the current path of the ditch water
return flow to the river. We purposely left a dyke between the two lakes in
the southwest portion of our property so water would return to the river.
The dotted line indicates a portion of the I.C. Woods that Mr. Glass still
insists exists, but we have not been able to locate any records or
documentation to verify this. By showing this line on the map, Western
Mobile under no circumstances agrees that our mining operations have
destroyed this portion of the ditch or that we are using the water he owns.
A Redland Grnup company
