<br />application,a reclamation plan and sap, and the required fee, as required 'oy law; and
<br />tdHEREAS, on

<br />WHEREAS, on
<br />surety submitted by
<br />date of issuance of
<br />Apr i 1 24 19 80 , the `lined Land
<br />Inc. application and set
<br />May 29 , 19 80 , `the `tined Land
<br />Elam Construction, Inc. and
<br />the perait and the anniversary date
<br />Reclamation 3oard approved
<br />band; and
<br />Reclamation Beard accepted
<br />such date shall be considered the
<br />for all other purposes; and
<br />WHEREAS, [he ".fined Land Reclamation Board has made a finding, Eor the purposes
<br />of issuing this permit, that:
<br />1) the application complies with the requirements of the Co lotado
<br />`!fined Land Reclamation Act and a1'_ applicable local, state and
<br />Federal laws; and,
<br />'_) the operation will not adversely affect the stability of any
<br />significant, valuable, and permanan[ man-made structures located
<br />within two hundred feet of the affacted land, 2:CCeDC '.TR2Le there
<br />is an a;reemenC between the operator and the persons having ar.
<br />interest in the structure that damage to the structure is to be
<br />compensated for by the operator; and,
<br />3) the proposed mining operations and reclamation can be carried out
<br />in conformance with the requirements of C.R.S. 1973, 34-32-116, as
<br />amended (1976 Sess.,Laws H.B. 1065); and
<br />h°HEREAS, for [he purposes of issuing this permit, the operator has made a
<br />satisfactory showing to the Eoard that he ~.ui11 employ during and after his
<br />open mining operations procedures reasonably designed to -fir.:-ice
<br />as much ss practicable the disruption [tom the open min in; ooeracoas
<br />and will provide for the rehabilitation of the affected lard chrouzh t;:e rehabilitation
<br />of plant cover, soil stability, water resources, and other measures appropriate to ~:he
<br />subsepuent beneficial use of such mined and reclaimed lands; and that in the event
<br />of the failure of his proposed reclamation plan, he will take whatever measures which
<br />may be necessary in order to assure [rte success of reclamation of the lands affected
<br />by his open Mining operations; anG,
