Long Division Director The Division of Minerals and Geology hereby issues notice, in accordance with Title 34, Article 33, Section 118, Paragraph 3, of the Colorado Revised Statutes, that on July 17, 1997, an application to renew an existing permit to conduct coal mining operations at the Roadside Portals was considered complete for the purposes of filing. All review and comment periods as provided in the Act and the Regulations initiate from this date of filing. The applicant proposes to continue underground coal mining and/or reclamation operations on land located approximately 5 miles north of Palisade. The permit area is further described as follows: T10S, R98W, 6th P.M.; Sections 20, 21.22, 23, 26, 27, 28, 29, 34 and 35 T11S, R98W, 6th P.M.; Sections 1, 2, 11, 12, 13 and 14 T11S, R97W, 6th P.M.; Sections 6, 7 an d 18 TLS, R2E, Ute P.M.; Section 1 The above-mentioned tracts of land are shown on USGS 7.5 minute Cameo and Palisade Quadrangle maps. This application is for successive renewal of a currently permitted operation. The application does not propose any changes to the existing permit, but would allow operations to continue within the previously permitted azea for an additional 5 year permit term. In order for us to approve this renewal, we are required to make a finding that "the activities would not affect the continued existence of endangered or threatened species or result in the destruction or adverse modification of their critical habitats as determined under the Endangered Species Act of 1973...." We request your review and recommendation pursuant to this finding. Please advise us if you require additional information. In order for us to comply with regulatory time frames, we request that comments be submitted to the Division of Minerals and Geology at the above address by 5:00 p.m. on September 15, 1997. If no comments are received by this date, we will proceed on the assumption that your agency has no concerns with or objections to the applicant's proposal.
