I spent some time going over it and making sure all the details required by <br />Rule 3.03.2(1)(b) were included. This is something that we have been really making sure everything is complete <br />and included. I have added my comments directly on to your draft with the appropriate rule citations. You've got <br />the majority of it. Just a few specifics that need to be added. On the landowner notification letter, it looks good. I <br />just want to make sure that you noted that adjacent property owners, county commissioners, local government <br />bodies, etc. in accordance with Rule 3.03.2(1) need to be contacted as well. <br />I do have a bit of a concern about the 6.5 acres at the mine site that were topsoiled and seeded in 1999. I made <br />a point to note in my review of the 2005 8 2006 vegetation sampling data, that the 1999 reclaimed areas are not <br />yet eligible for phase III bond release, nor did you sample two consecutive years on the 1999 area. The 6.5 acre <br />1999 reclaimed area is eligible for Phase II release. I did not see that specified in the public notice and I was <br />concerned that it was being lumped with the rest of the eligible reclaimed mine site area. <br />If we can get the 6.5 acre 1999 area phase II released, I believe we can reduce the inspections to quarterly at that <br />point in time. <br />So far, so good.
