Lung <br />Division Director <br />Byron, on-going discussion with Jim Stover of Mirtrec and working through the files, we have <br />come up with this situation regarding Blue Ribbon. 1 will review the situation just to save you <br />the trouble. <br />Blue Ribbon's findings documents indicate they had requested a waiver of the AOC requirement <br />for steep slope mining. <br />A search of their permit reveals a partial stability analysis (determined insufficient by you) but <br />not a complete analysis NOR is there any evidence in the files that any waiver was officially <br />granted. <br />Your analysis of the conditions at the site indicated that a waiver of the AOC requirement was <br />not really needed. However, a stability analysis is needed because of the steep slope conditions. <br />Subsequent discussions with Minrec have revealed that one of the original stipulations in the <br />permit was the completion of "an acceptable stability analysis of the proposed backfilled <br />configuration of all mine facilities." <br />The midterm findings document dated 12 July 1985 indicates that this stipulation has been <br />satisfied, with the stability analysis contained in a stand-alone document titled "Stipulation <br />Respotise Document." Therefore, it appears that all requirements have been satisfied and we <br />are in good condition with regard to the backfilled bench at Blue Ribbon, even though the <br />situation was not described correctly in subsequent findings documents. <br />Thanks for your help. <br />
