Cottony <br />Division Director <br />Natual Resource Trustee <br />Amendment AM-Ol to the Empire Pit permit describes a levee that will be constructed along the right <br />bank of the West Fork of Clear Creek. The levee will prevent the probable maximum flood from <br />spilling into the proposed reservoir. The levee will also serve to raise water surface elevations and <br />increase the size of areas inundated during extreme flooding through the Town of Empire and other <br />downstream property. If the areas south of the proposed levee aze not in the jurisdictional floodplain <br />(100-year floodplain), then construction of the proposed levee may proceed without having to address <br />the potential for increased downstream flooding that maybe caused by the levee. If the areas south of <br />the proposed levee aze currently in the jurisdictional floodplain, then the Applicant should have an <br />approval from the local floodplain authority to construct the levee.
