Long <br />Division Dnram <br />I have reviewed the currently approved permit application package for the Deserado Mine, <br />per your request. Following are deficiencies I identified during that review. <br />1. It does not appear that we have construction certifications ("as built") for the following <br />sediment ponds and/or impoundments: PP-1, PP-2, RP-1, RP-2, RP-4, RR-1, RR-2, <br />RR-3, RR-4, SS-1, SS-2, SDH#3, SDH#4, and the four sumps in place on the East <br />Portal pad. Please provide the certifications for those ponds as required by Rules <br />4.05.6(10) and 4.05.9(10). <br />2. Please update Table V-2 on page V-6 to include all ponds and impoundments on site. <br />3. Maps for the East Ventilation area do not depict the existing sediment control <br />structures. Please update or remove Map VE-1, Map 20, and Map 32. <br />During my review, I noticed that most of the ditch designs are based on rip rap or vegetated <br />channels. You may want to verify the construction of those ditches. <br />You asked that I review water replacement/alternative water supply issues. WFU predicts no <br />diminution in quality or quantity of surface water, and therefore has not obtained replacement <br />water rights. Provided you have verified this prediction, replacement water rights would not <br />be required. <br />As we discussed, my comments are based on a preliminary review. Since my comments are <br />due today, I did not have the necessary time to complete a detailed review. I would be happy <br />to complete my review at a later date if you would like.
