MANAGEMENT ,~ <br />~ ,~ <br />:~ <br />On behalf of Snowcap Coal Company, encosed is an application for a technical revision to amend the <br />reclamation schedule to allow the Operator additional lime to finalize the sale of the property and to submit <br />a completed permit revision for a land use change to the Division. <br />This request involves the remaining structures at the South Portal. Tho schedule for the associated <br />regrading and seeding work will also be amended. Revised pages 5 and 10 of Figure 14-1 are enclosed. <br />In preparation of the sale of the property, Snowcap Coal Companys legal department pertormed a title <br />search and defects were found that we are currently trying to correct prior to finalizing the sale. After the <br />title defects are corrected, J.E. Stover & Associates, Inc. will be given an appropriate amount of time to <br />make the necessary changes to the permit and submit these changes as a permit revision to the Division. <br />At this time we anticipate the submittal of the permit revision to be during the first quarter of 2006. <br />Also enclosed, but not to be incorporated into the permit, is a copy of the lease with the prospective buyers, <br />Providence Place, Inc., signed on May 24, 2005. To date, the lessee has cleaned up the buildings on the <br />lower portion of the South Portal, opened a fruit stand and installed a septic system for these facilities. The <br />septic system required an increase to the bond, which Snowcap Coal Company complied with, and was <br />approved by the Division, MR-69, on July 25, 2005. <br />Snowcap Coal Company, Inc. and Providence Place, Inc. have every intention of completing the sales <br />transaction as soon as all land issues have been addressed.
