Virginia <br />Gunnison, CO 81230 <br />NOV 12 1999 <br />Division o1 Minerals ri Geology <br />Re: Response to Concerns Regarding Oxbow Mining, Inc.'s Application for Land <br />Use Change, Ells Creek Mine Facilities <br />Dear Mr. Starkebaum: <br />In response to the concerns that you expressed to me by telephone two weeks ago regarding , <br />Gunnison County's proposed land use change approval schedule, State and Federal agencies' <br />permit approval schedules, and compliance with conditions of the past land use change <br />approval, Oxbow Mining, Inc. ("OMI") provides the following information. <br />OMI will be meeting with the Colorado Division of Minerals and Geology ("CDMG") on <br />Friday, November 12, 1999, to discuss the remaining questions on the Elk Creek 1\tine <br />facilities construction per Technical Revision 32. A request to extend the proposed decision <br />date for this application to December 17, 1999 will be submitted to accommodate final <br />responses. With this approval, the CDMG will have obtained the appropriate State and <br />Federal agencies' concurrence, including the Division of Wildlife, the Department of Public <br />Health and Environment ("DPH&E'~, and the Office of Surface Mining. <br />Attached are copies of the approved Construction (air emissions) Pertnit from the DPH&E <br />and the Nationwide General Permit 2] approval from the Army Corp of Engineers for the <br />Elk Creek Mine facilities project. The DPH&E approval of a new CDPS water discharge <br />point is pending and has apparently been delayed thus far only because of the heavy <br />workloads of the Water Quality Control Division. Approval is anticipated b}' the Division <br />some time in January 2000. <br />OMI has again reviewed its current, approved air permit to ensure that the required controls <br />and maintenance are being conducted. This review showed that OMI's operations are being <br />operated within the permitted emissions levels. I have visited with and inspec[ed some areas <br />of concern with local residents and am working with. them to minimize their perceived <br />impacts.
