The revision was submitted to abate problems noted <br />during the Division's September 25, 2005 inspection of the Pine Ridge Pit. The Division has the <br />following items that need to be addressed prior to approval of the revision. <br />Based on the information in the TR-Ol, it appears that the Templeton Ditch is owned by four <br />individuals; Dick Millet, Christiana Kern, Pat Chant, and Stefan F. Lani. ACA Products <br />provided signed agreements to relocate the Templeton Ditch with the owners of the structure, <br />with the exception of Dick Millet. Because Dick Millet is part owner of the ditch (assuming <br />'/< owner), ACA Products must get his consent to relocate the ditch. If an agreement cannot <br />be reached ACA Products can either demonstrate to the Division that Dick Millet no longer <br />is a partial owner of the ditch, or rebuild the ditch in its original location. <br />2. ACA Products provided revised Mining and Reclamation Plan Maps to depict where the <br />Templeton Ditch will be relocated. However, the maps contain the location of the original <br />ditch indicating that the ditch will remain in its current location. During the Division's <br />inspection, it was noted that the ditch has been mined through. Please revise the maps to <br />depict the current mining and reclamation plans through the Templeton Ditch. <br />3. Please describe the general dimensions of the relocated ditch. Irl particulaz, please state the <br />depth, width and side slopes of the ditch and provide a cross section. Please also state how <br />the ditch will be stabilized. If a seeding is proposed, please include the seed mixture and <br />application rate in pure live seeds (PLS}. <br />Please be advised that the Pine Ridge TR-Ol Application maybe deemed inadequate, and the <br />application maybe denied on December 16, 2005 unless the above-mentioned adequacy review <br />items are addressed to the satisfaction of the Division. If you feel more time is needed to <br />complete your reply, the Division can grant an extension to the decision date.
