Canany <br />Division Director <br />Natural Resource Trustee <br />The Division received Technical Revision (TR-09) for the Lyons Quarry, Permit No. M-1977-208 operated by <br />CEMEX, Inc. The revision provides the hydrogeologic investigation of C-Pit and recommendations for the <br />long-term ground water monitoring program. The Division has the following questions that will need to be <br />addressed prior to approval of the revision: <br />1. Please find the attached comments regazding the hydrogeologic investigation and changes to the <br />ground water monitoring program at the site. <br />2. The report notes the degradation of shotcrete lining within the Boulder Feeder Cana] and possibly <br />water migrating to the C-Pit as noted by seeps in the highwall and well vegetated azeas. Based on the <br />report, it appears that water from irrigation ditches aze migrating into the C-Pit. In order to reduce the <br />water flowing into the C-Pit and coming in contact with the cement kin dust (GIGO), CEMEX will <br />need to provide a plan to limit the seepage flow of water into the C-Pit. <br />3. The report indicates that leakage from the A-Pit water line is a possibility due to the past occurrence of <br />the line breaking and the fact that the highwall in the vicinity of the A-Pit is wet. Please provide a plan <br />to investigate the condition of the A-Pit water line and a mitigation plan in the event water is migrating <br />into the C-Pit. <br />4. CEMEX is required to monitoring wildlife on the site in the vicinity of the C-Pit. Please inform the <br />Division if the wildlife monitoring and reporting plan will change as a result of the backfilling of a <br />majority of the pit and the recently installed net on the exposed water in the C-Pit. <br />Please be advised that Division's decision due date is set for October 10, 2007. If you feel more time is needed <br />to complete your reply, the Division can grant an extension to the decision date. This will be done upon <br />receipt of a written waiver of your right to a decision by October 10, 2007 and request for additional time. <br />This must be received no later than the deadline date.
