Box 591 <br />Somerset, CO 81434 <br />RE: Preliminary Adequacy Review; Technical Revision No. 67; West <br />Elk Miae; Permit No. C-80-007 <br />Dear Mr. Barbe; <br />The Division has reviewed Mountain Coal Company's application for <br />a technical revision to construct a materials storage bench. This <br />preliminary adequacy review will address concerns in the areas of <br />cultural resources, vegetation, soils, wildlife, slope stability, <br />hydrology and bonding. A section for general comments is also <br />included. MCC should respond to the Division's concerns by March <br />9, 1994. If you should require additional time, please request an <br />extension to this due date. The Division must issue a proposed <br />decision on March 21, 1994. <br />GENERAL COMMENTS <br />1. The MCC application does not explain why 17.4 acres is being <br />disturbed to construct a 3.65 acre storage bench, widen a 780' <br />long road, and construct a truck pullout lane that is less <br />than 0.5 acres in size? Specifically, why will the area above <br />the bench in subwatersheds 9A and 35A be disturbed? From <br />review of the cross-sections, it appears that this area will <br />receive some fill. Is there excess material that will not be <br />used for the bench fill? Is there a better location for this <br />excess material (i.e.-subsoil or topsoil pile)? The Division <br />would encourage MCC to limit the size of the disturbance as <br />much as possible. <br />2. What type of surfacing material will be used on the storage <br />bench and associated access roads? <br />3. What type of materials will be stored in this area? <br />4. Map 53 should be updated to identify this area as a materials <br />storage bench. <br />
