Dinvon Direclnr <br />S~~ L: I <br />RE: Montoya Pit, Permit No. M-1980-146, Technical Revision No.1 Preliminary Adequacy Review <br />Dear Ms and Mr. Gilleland: <br />DMG has reviewed C and J's application for Technical Revision No. 1 (TR-001) to the Montoya Pit <br />operation, Permit No. M-1980-146, addressing changes in the mining and reclamation plans <br />detailing specifications for the pit created in the pit floor at the southwest corner of the site, and <br />for changing the excavation of the north and west highwalls to allow vertical highwalls that will <br />be backfilled to 3H:1 V slopes. <br />The application cannot be approved until the following concerns and comments are adequately <br />addressed. C and J's response must be received no later than December 28, 2000 so the <br />decision due date of January 3, 2001 can be met. Failure to respond by that date may result in <br />denial of the TR-001 application. <br />ADEQUACY COMMENTS <br />1. The application mentions that a near vertical highwall will be maintained on the west side as <br />allowed by BLM. Both the Reclamation Permit issued by the Mined Land Reclamation Board <br />and the BLM lease conditions indicate that the west highwall will be mined at a 2H:1 V grade. <br />I talked to Mr. Loren Wickstrom with BLM and he indicated that he was overlooking the <br />deviation from their requirements because the pit was nearly mined out and needed gravel <br />until the leasing of the adjacent mining block was completed. However, without a revision to <br />the reclamation permit, this situation cannot be overlooked by DMG, because it results in the <br />operation being under-bonded for reclamation. C.R.S. 34-32.5-117 (6) (a! of the Colorado <br />Land Reclamation Act for Extraction of Construction Materials requires that the financial <br />warranty be maintained in good standing for the life of the mine and that the financial <br />warrantor immediately notify the Board of an event that may impair it's warranty. <br />The drawings submitted by Southwest Land Services as part of the TR-001 application <br />indicate that there is currently a 600 foot long by 40 foot high vertical section of the west <br />highwall. DMG assumes that this is the near vertical highwall specified in the proposed <br />revision to the mining plan and that these dimensions are the maximum proposed dimensions <br />for the west highwall.
