The decision is to approve the minor revision with <br />one stipulation. The stipulation is that the mine operator must submit to this Division, as soon as <br />possible, proof of the resolution of an audit violation in West Virginia. <br />Appazen[ly, one of the directors of W.R. Grace & Co., Thomas A. Holmes, has been linked, through <br />AVS, with Newmont Mining Corporation, which, in turn, is linked to Sterling Smokeless Coal. <br />This last company is appealing a January 1, 1989 West Virginia audit violation, No. 93021 1 1 3 8, for <br />$35,880.00. Hence, the AVS system recommendation was for a conditional issue. Enclosed aze <br />copies of the AVS printout. <br />As we had discussed over the telephone, the end dates for Hugh L. Carey and the other officers and <br />directors no longer working at W.R. Grace & Co. and W.R. Grace & Co. -Conn. have been put into <br />the AVS system.
