We will <br />continue to use the .materials noted in the original permit <br />application that included overburden, As currently stated the term <br />REFUSE was used in the original application text and the Board <br />asked us to specifically spell out what "refuse" is. The defini- <br />tion of "refuse" that will now apply to this facility is any <br />material the specifically meets the Department of Healths Defini- <br />tion of "Inert Fill". Their definition pretty well spells out what <br />we would use as backfill material, the following is a direct quote <br />from their regulations: <br />"nonwatersoluable and nonputrescible solids together with such minor amounts and <br />types ojother materials as will not significantly affect the inert nature ojsuch solids <br />according to the rules and regulations of the board. The term includes but rs not <br />limited to, earth, sand, grove[ rock, concrete which has beers in a hardened state for <br />at least sixty days, masonry, asphalt pavement fragments, and other inert solids <br />including those the board of health may identify 6y regulation. " <br />If any of this material is imported for fill we will comply with <br />Adams County Regulation and State Heath Department regulations <br />prior to importing any material. If it is determined we need a <br />Certificate of Designation (CD) we will obtain one. We believe <br />this is consistent with the MOU the DM&G and the Health Dept. <br />signed in November, 1992. Which recognizes that fill materials <br />generated on the site can be use as backfill materials. <br /> <br />
