This is to comply with the
"Corrective Action" of a MLRB inspection by Steve Schuey on October 7, 1998.
In regazds to the disturbed azea, south of the permit boundary, as discussed in the
"Observations" of Mr, Shuey's report, dozer tracks exist in this area due to berm
maintenance that is required when the river breaches the berm naturally, at various times.
ZMK attempts to help protect the residence south of their property, in addition to their
own property, each yeaz. During this past year, the berm was not breached in any
location; therefore, maintenance was minimal. If the berm is to be breached
intentionally, to allow material to flow into the excavated areas, this will be done entirely
within the permit boundary. Some tracks are just south of the excavation area where
slope grading was being done. The operator assures that future work of this type will be
contained entirely within the permit boundary, unless emergency measures are required
to protect neighboring land or the facilities associated with the operation.
Thank you for your consideration of these matters. If any other questions arise,
please contact me for additional information.
Si~ncnerely~
~ "'
Robert A.
