"aural ource Trustee <br />Dear Mr. Lewicki: <br />Staff has completed the review of the above referenced amendment (AM-O1) to change the post mine land <br />use from rangeland to commercial residential. Due to an error in the publication of the public notice <br />extending public comment up to the Decision Date of the 13`", which is a legal holiday, the decision on the <br />amendment had to be pushed back to the 15t" of October to accommodate any comments from the public. <br />No additional comments were received and staff may now approve the amendment. <br />It is the Division's understanding, that the change from rangeland to commercial /industrial is contingent <br />upon local approvals of a Special Use or Conditional Use Permit. In the event that such approvals are not <br />granted, the operator wishes to maintain the current approved post mine land use of rangeland. The <br />operator must supply documentation to this Office to support the final decision by the local authority prlOf to <br />any site or firiancial warranty release requests, as staff will have no basis to refer to in making a decision on <br />those matters.
