On behalf of our client Platte Sand & Gravel LLC I am filing
this petition to the Board is to appeal the Divisions ruling on the
Technical Revision (TR02) submitted on May 27, 2004. We request a
hearing before the Colorado Mined Land Reclamation Board at the May
2004 hearing to present information and request a reconsideration
of the decision. We do not believe the request, to install a
slurry wall around the lakes so the area can be mined dry, is
extreme enough to warrant an amendment for this end use. We be-
lieve that the resulting lakes can still be used for recreation and
the groundwater impacts associate with lining the lake areas can be
mitigated easily. The evaporative losses from groundwater lakes
will be eliminated. In addition, any increase in the ground water
table would be retained on the mine site and have no impact to
surrounding properties, so this end use will not have an adverse or
significant impact on the surface or subsurface hydrologic balance
in the aroma. For ciiese reasons we believe this minor change should
be a Technical Revision instead of an amendment.
