Banta. <br />MpR 0 7 1991 Division Director <br />Mined Land <br />Reclamation Division <br />Re: File No. M-91-009, White River S & G, 110(2) Application <br />Upon reviewing your application for a Mining and Reclamation Permit, received <br />February 19, 1991, we have determined that the following must be submitted in <br />order for application review by the Division: <br />Complete and return two (2) executed copies of the enclosed Limited <br />Impact Operation (110(2)) Reclamation Permit Application Form and all <br />necessary exhibits as described in the application form and enclosed <br />Rules and Regulations. <br />Please be advised that there are new permit application requirements based on <br />rule changes, effective January 1, 1991, which pertain to the notice <br />requirements at the time of application submittal. These changes have been <br />noted below: <br />2. An affidavit or receipt indicating the date on which the application <br />was placed with the local county clerk and recorder (Rule 3.2(1)(n)). <br />3. Send a notice on a ~ approved by the Board, to the local board of <br />county commissioners and, if the mining operation is within the <br />boundaries of a soil conservation district, to the board of supervisors <br />of the soil conservation district,(forms enclosed in the application). <br />The applicant shall include proof of such mailings with the application <br />at the time the application is submitted to the Division for filing <br />(Rule 3.2(3)(b)(i)). <br />Failure to follow these notice requirements will result in a decision to deny <br />your application. You may amend the application you submitted on <br />February 19, 1991 by submitting two completed application forms, exhibits, and <br />proof of these notices.. In accordance with Rule 1.5, a new decision date will <br />be established 30 days from the date of receipt of these items. If you have <br />already initiated publication; you will need to republish notice which <br />specifies a ten (10) day public comment period from the new date of newspaper <br />publication. <br />
