CO-0043648 and CO-0024562. The permit defines <br />an upset condition as "an exceptional incident in which there is unintentional and <br />temporary noncompliance with permit effluent limitations because of factors beyond the <br />reasonable control of the permittee. An upset does not include noncompliance to the <br />extent caused by operational error, improperly designed treatment facilities, inadequately <br />treatment facilities, lack of preventative maintenance, or careless or improper operation." <br />The Division made the determination that the Carlton Tunnel reported exceedences for <br />May and June of 1999 were caused by an upset condition. The Division made the <br />determination that, due to the complex nature of the Arequa Gulch site, the precipitation <br />events in the spring of 1999 were likely to have had a significant influence on the levels <br />of cyanide in the wastewater discharged from outfall 001 A to Arequa Gulch and we did <br />not pursue a formal enforcement action regarding the reported exceedances at OOIA for <br />May through August 1999 based on that belief. <br />We are enclosing a copy of our original letter on this issue for your information. <br />If you have any questions regarding this matter, please contact me at (303) 692-3509. <br />Sincerely, <br />~/"~ ~. <br />J.
