The DMG's letter dated January 10, 2003 transmitted its comments and concerns
regarding the Bear No. 3 Mine permit renewal. On behalf of Bear Coal Company, Inc.,
following are its responses to the DMG's comments and concerns.

3. A discussion of sediment pond removal was added to amended page 2.05-35a.
4. No response required.
5. BCC will consider the DMG recommendations regarding vegetation monitoring
during 2003.
6. BCC is unable to perform the soil sampling until at least May 2003. Please
structure the approval of this permit renewal to allow BCC time to perform the
required soil sampling.

8. Enclosed in an amended Map 1, Surface Ownership.

11. Notice of violation CV-2000-006 was added to page 2.03-13.

13. A discussion of subsidence and slope stability monitoring was added to page 2.05-
iii. Enclosed are the three amended Exhibit 22 pages you were missing. BCC
hereby retracts its request for a technical revision to revise the subsidence and
hydrologic monitoring programs.
14. The page numbering was corrected. The Tony Bear Ghipeta Spring was added to
page 2.05-55. Page 2.05-i was clarified to state that "water emerged from an area
near the old Edwards mine". Drainage pipes were installed in the portal seals of the
Bear No. 3 Mine. Map 17 was revised to show the approximate location of the
pipes. Enclosed are amended pages 2.05-55 through 2.05-55c.
