On behalf of Bear Coal Company, Inc., <br />following are its responses to the DMG's comments and concerns. <br />1. No response required. <br />2. No response required. <br />3. A discussion of sediment pond removal was added to amended page 2.05-35a. <br />4. No response required. <br />5. BCC will consider the DMG recommendations regarding vegetation monitoring <br />during 2003. <br />6. BCC is unable to perform the soil sampling until at least May 2003. Please <br />structure the approval of this permit renewal to allow BCC time to perform the <br />required soil sampling. <br />7. No response required. <br />8. Enclosed in an amended Map 1, Surface Ownership. <br />9. No response required. <br />10. No response required. <br />11. Notice of violation CV-2000-006 was added to page 2.03-13. <br />12. No response required. <br />13. A discussion of subsidence and slope stability monitoring was added to page 2.05- <br />iii. Enclosed are the three amended Exhibit 22 pages you were missing. BCC <br />hereby retracts its request for a technical revision to revise the subsidence and <br />hydrologic monitoring programs. <br />14. The page numbering was corrected. The Tony Bear Ghipeta Spring was added to <br />page 2.05-55. Page 2.05-i was clarified to state that "water emerged from an area <br />near the old Edwards mine". Drainage pipes were installed in the portal seals of the <br />Bear No. 3 Mine. Map 17 was revised to show the approximate location of the <br />pipes.
