iiiiiiiiiiiiiii
STATE OF COLORADO
MIMED LAND RECLAMATION DIVISION
Deparlmeni of Natural Resources
1313 Sherman St., Room 215
Denver, CO 80203
303 866-3567
Fn%. 303 8328106
DATE: May 13, 1990
T0: Matthew Hayes
FROIM: Cathy Begej C~~(,~I~j,,~/_
((~J '"'~
pf COrO
ti~~~9
H~~~
•r~°
r ~
~ /e ]6 ~
Roy Romer,
Governor
Fretl R Banla.
Division Director
SUBJECT: Somerset Permit Renewal, 4/26/ 0 Adequacy Responses Review, C-81-022
I will accept the operator's request to delay preparation of projections
of flooding to the 1990 Annual Hydrology Report with two conditions:
1) The report must be submitted by May 15, 1991; and
2) The submittal includes a permit revision with a modified Probable
Hydrologic Consequences section.
I haven't any idea when the Annual Hydrology Report is due, The last one
came in September, 1989, The second condition is predicated on the fact
that the Findings will have to be modified to address this revised PHC.
Ask Jim if he would like to make a permit commitment to do this, or if he
would prefer a stipulation,
14, The Division is unable to accept the statements "There are other small
areas, within the disturbed areas, where run-off is not contained in
sediment ponds. The operator provides alternate sedimentation control
for all of these areas where practical," Demonstrations of sediment
control must be made for all small area exemptions on a site-specific
basis, Failure to provide this information, within the permit
application, will be grounds fora violation if it appears that surface
water runoff from disturbed areas does not pass through a pond.
Furthermore, some sort of alternative sediment control must be utilized
in areas identified as small area exemptions.
The Division is unable to find the maps referenced in the response to
question 14: tAap E8-3446 nor ES-3253, Please provide two copies of
these maps as well as the June, 1984, Elk Creek Yard revision, which we
are also unable to find.
16. Response is acceptable.
CB/evm
7971E
