Walker, Byron <br />From: Jerry Nettleton [JNettleton@peabodyenergy.com] <br />Sent: Tuesday, December 05, 2006 3:10 PM <br />To: Walker, Byron <br />Subject: Twentymile Coal Company - Foidel Creek Mine (C-82-056), PR06-07 -Responses to <br />Remaining Adequacy Items <br />Attachments: PR06-07 Revised pages 2.05-3 and 13.doc; CURRENT.TOC1106.doc; EXHIBIT 2 Slip <br />Sheet.doc <br />®~ ®I <br />PR06-07 Revised CURRENT.TOC1106 EXHIBIT 2 Slip <br />pages 2.05-3 a... .doc (122 KB) Sheet.doc (24 K... <br />Byron - <br />As a follow-up to my 12109106 e-mail on the remaining PR06-07 adequacy <br />items: <br />1) Correction of the Permit Area acreage figures for consistency - There is a discrepancy <br />between the acreage figures shown in your 12/01/06 e-mail, as carried forward in the CDRMS <br />system, and the figures we have carried forward in both the PAP documentation and our <br />Annual Reclamation Report. <br />For the Permitted Area and Disturbed Area acreages, the discrepancy is less than 10 <br />percent, however, the Affected Area figure in your 12/01/06 e-mail is significantly <br />greater that the figure we are carrying, and appears to be incorrect, based on the acreage <br />within the permit area that has not been affected and the acreages for areas that are <br />outside of the currently permitted area (5-year mine plan, specifically most of the <br />Western Mining District). <br />We have reconciled the current acreage figures presented in the PAP for consistency, and <br />propose the following to address the identified <br />discrepancies: <br />For the Permitted Area, we have the land plat information available <br />electronically from Routt County, and propose to utilize the actual <br />platted acreages to determine the Permitted Area acreage based on Permit <br />Boundaries corresponding to plat boundaries. <br />It may be necessary to adjust our map base layer for consistency with <br />the more accurate land plat information. We will make any necessary <br />adjustments, and create a new base layer. <br />We will overlay the Permit Boundary, mine plan (with angle of draw <br />subsidence limits), and disturbance areas, and then using the outlines <br />of these areas, will use an AutoCAD utility to determine corrected <br />acreages for the Affected and Disturbed areas. <br />The corrected acreage figures and map(s) will be incorporated into the Permit Revision <br />application we anticipate submitting in January for the new Federal Coal Lease that we <br />anticipate will be issued by year-end. This approach has the dual benefits of allowing us <br />to proceed to decision on PR06-07, while correcting all relevant acreages for both the PAP <br />and the <br />2006 Annual Reclamation Report. <br />2) Revisions to Maps 1 and 2 to address ownership information, permit boundaries, and <br />revision dates - The referenced maps have been updated and revised to show all recent <br />changes in ownership (based on records form the Routt County Assessor's Office), the <br />permit boundary change approved through TROS-51, and corrected map revision dates. <br />3) Addition of a new exhibit for ownership information - On review of the current PAP, it <br />1 <br />
