This review is conducted in response to your subject request. Our rules do not cover high-wall
mining. The operator has elected to submit the proposal under the provisions of those applicable to
Auger Mining. This follows Division precedence, and I concur. This memorandum has been placed
on your "M" drive incase you care to lift any of these words. Materials reviewed returned to Sandy.
Rule 2.06.9 Augering
Rule 2.06.9(1) Scope. 2.06.9 applies to any person who conducts or intends to conduct surface coal
mining and reclamation operations utilizing augering operations.
Applied in this application for highwall mining.
Rule 2.06.9(2) Any application for a permit for operations covered by 2.06.9 shall contain, in the
mining and reclamation plan, a description of the augering methods to be used and the measures to
be used to comply with 4.23.
The application is shy of a complete description, and there is one conflict in the descriptions of
which coal seams are to be mined by the highwall method. On page 12-4-1 highwall mining is
proposed in the Wadge and Wolf Creek coal seams. On page 12-4-2, highwall mining is proposed in
the Wadge, Sage and Wolf Creek coal seams. Suggest the following adequacy comments be
provided to the applicant: "Please add the Sage coal seam to the list of seams to be mined
(Wadge, Sage, and Wolf Creek) on page 12-4-1. These three seams are listed on pages 12-4-2
and 12-4-3. Please expand the proposed mining plan description of multiple-seam highwall
mining to include the vertical relationships of mining activities. Please indicate on Drawing 12-
3 those areas of multiple-seam mining, including the identity of the seams. Please identify to
which seam the currently drawn proposed penetrations and limits of highwall mining apply,
and provide a cross section that illustrates the staggering, if any, of lines of highwall hole face-
ups and limits of penetration:'
