Lang <br />Division Director <br />~~ <br />RE: Comments on Andesite Rock Company, Carr Gravel Resource Amendment, Permit No. M- <br />1988-048, AM-001 <br />Dear Mr. Shay: <br />The Division has reviewed the above referenced Amendment application in light of your comments <br />regarding evaporative losses of water. The application specifically proposes lining the pit with a clay liner. <br />Any water stored in the pit would not be groundwater from the site but would be appropriated water under <br />a permit from the Office of the State Engineer. Therefore, there would be no violation of our law. In <br />addition, it is a general policy of the Division [hat the operator and/or the land owner has the right to choose <br />the final land use as long as it results in a beneficial final land use.
