Nothing of this sort was included with the County's response.
Please provide written evidence of such personal service.
EXHIBIT E (Rule 6.4.5 (2) (f) (iv)): The Division will accept the County's proposal to salvage
approximately 6 inches of topsoil in order to ensure that a minimum of 3 to 4 inches of the resource will be
available for use in reclaiming the site. The corrected Exhibit E statement'"The thickness of plant growth
vegetation shall be a minimum of the 25% that presently exists on site.", however, remains confusing to the
Division. if this statement is intended [o mean that the vegetative cover resulting from reclamation of the site is
only to be 25% of that presently on site, the Division cannot accept this as the standard required for release. Rule
3.1.10 (I) states that "--------land shall be revegetated in such a way as to establish------vegetative cover----at least
equal in extent of cover to the natural vegetation of the surrounding area."
Please either make the meaning of the statement clearer and consistent with the requirements of Rule
3.1.10 (I) or withdraw i[ altogether from the Exhibit E narrative.
NOTE: In the absence of any objections, the decision date for this application is July 25, 2000. With the
exception of the issues identified above, the County has met the minimum requirements Cor approval of the
application. Please respond fully to the remaining adequacy issues prior to July 25, 2000 in order [hat the'
Division may consider approval of the application at that time. If you cannot do so, please provide a written
waiver oCyour right to a decision at that time in order to avoid a denial and to allow the permitting process
to continue.
If you have any questions on the above, please contact me.
Sincerely,
~ctw>e~ G s~y~Qt,LA
James C.
