Donald <br />~.~ ~~ <br />p ~ Qu -f ~l-~ <br />~~ \ - ~ g <br />DATE: Costilla County and Battle Mountain Resources <br />SUBJECT: October 31, 1990 <br />-IIZ <br />This memo is in response to your request, dated October 15, 1990, <br />for additional information about Battle Mountain Gold, San Luis and <br />Costilla County. <br />This has been a controversial issue for a considerable period of <br />time. The controversy has been somewhat difficult to read accurately <br />since the community is divided in its support for the project. For <br />example the previous mayor of San Luis favored the project; the current <br />mayor is more skeptical about its merit. <br />We understand that the group with whom you met also met with Jim <br />Scherer at EPA. EPA has apparently offered some support. We will work <br />with EPA and the community to improve the level of understanding about <br />the environmental dimensions of this project. <br />A question was raised about the need for an Environmental Impact <br />Statement (EIS). There is some federal jurisdiction at this site. The <br />U.S. Army Corps of Engineers issued a Nationwide permit to Battle <br />Mountain for its activities affecting the Rito 5eco as required by the <br />Clean Water Act. The Corps, which could have initiated an EIS, <br />determined that the project had minimal impacts on areas of federal <br />jurisdiction and, consequently, decided that a full EIS was not warranted. <br />The questions raised in your memorandum are addressed on the <br />following pages. <br />
