Dear Mr. Canning:
Thank you for the Midterm response dated March 26, 1991, Please forward the
results of the transformer sampling at your earliest convenience. A request
for additional information regarding the Identification of Interests section
of Permit No. C-81-011 has been sent under separate cover. Your responses
regarding the annual hydrology report requirement, and the disposal and/or
storage of non-coal waste are appropriate.
As stated in our Midterm Review dated December 21, 1990 (Section VI), we have
calculated a new bond amount for the Apex No. 2 mine permit. It is our
understanding that Sunland Mining Corporation does not intend to protest the
new bond amount. Therefore, pursuant to Rule 3.02.2(4), the Division hereby
requires Sunland Mining Corporation to submit an increased bond for the Apex
No. 2 Mine, Permit No. C-81-011, in the amount of E172,000. The new bond mist
be submitted no later than June 1, 1991.
Sunland Mining Corporation is advised that Rule 3.02.2(4)(a) allows the
permittee to request an informal conference. Please notify us, no later than
May 1, 1991, if you intend to request an informal conference.
The decision to require the bond increase will be published in the Steamboat
Pilot as soon as possible. Finally, Rule 3.03.2(4)(c) allows the permittee to
