OF MINERALS <br />8 GEOLOGY <br />Re: Oxbow Mining, Inc. -Somerset and Sanborn Creek Mines (Permit No. C-81-022), Minor <br />Revision MR-49 -Small Area Exemption and Alternative Sediment Control -Coal Loadout Area <br />Dear Mr. Kline: <br />Accompanying this [ransmi[tal is a copy of the Colorado Division of Minerals and Geology's Proposed <br />Decision Form for Minor Revision MR-49, along with copies of all permit application materials and <br />I supporting documentation associated with these revisions. Minor Revision MR-49 addresses changes in <br />the drainage and sediment control measures For the existing coal loadout facility. These changes are <br />required due to modifications by the Union Pacific Railroad of the railroad tracks, switches, and rail <br />grade in the vicinity of the loadou[ facilities. The proposed changes include removal of the small existing <br />sedimentation pond (Pond A) and the use of alternative sediment control measures in conjunction with a <br />small area exemption to effectively control drainage from this area. <br />Specifically, this submittal includes the Proposed Decision Forms signed by the operator's authorized <br />representative and copies of revised permit materials (text and map) from [he MR-49 Minor Revision <br />Submittal. Revised permit materials are co be replaced or. inserted in [he Somerse[ and Sanborn Creek <br />Mines Permit document as indicated by the original transmittal letter.
