This memorandum is in response to your oral request to review the latest response. These
comments are provided without the benefit of a site visit. They are derived from a review of the
materials submitted there-under, sections of the earlier revision submittals, and the current Permit
Application Package (PAP) as referenced.
Not checked was response to a comment in my preceding review as follows. I did not find an
added item number for it in the response.
Volumes 12, 13 and 14 have been added for information regarding the South Taylor/Lower
Wilson activities. Please provide site-specific references to those parts of Volumes 1 through I1
that also apply to such activities.
Item 39. The response is accepted. The response is in compliance with the rules. See page Rule 2
Page 97, 3/30/07 and Rule 4, Page 2, 3/30/07 for the text with regard to the sediment ponds
access road, and Map25B, 3/28/07. In the construction notes on Map 25B is the notation that No
topsoil will be removed prior to surfacing. A variance for topsoil removal from the upgrading
(permanent gravel overlay) of this existing two-track dirt road is warranted as provided for under
Rule 4.06.2(a)(ii).
Item 67. The response is accepted. The response is in compliance with the rules. See page Rule 4,
Page 20, 3/30/07. Additional interceptor ditches above the fills are shown on Map 41 A,
03/23/07.
Item 68. The response is accepted. The response adequately demonstrates compliance with the
applicable rules for temporary overburden storage. Storage areas are the best available.
Item 105. The response is accepted. See Item 39.
Item 116. Defer to the cost estimator.
