<br />Permit Renewal Application No. 3
<br />Dear Sir or Madam:
<br />The Division of Minerals and Geology hereby issues notice, in accordance with Title 34, Article 33, Section l l8, Paragraph
<br />3, of the Colorado Revised Statutes, that on December 4, 1997, an application to renew an existing permit to conduct coal
<br />mining operations at the Foidel Creek Mine was considered complete for the purposes of filing. All review and comment
<br />periods as provided in the Act and the Regulations initiate from this date of filing.
<br />The applicant proposes to continue underground coal mining and/or reclamation operations on land located approximately 23
<br />miles southwest of Steamboat Springs, Colorado. The permit area is further described as follows:
<br />In portions of Sections 7, 8, 9, T4W, R86W; Sections 32 and 33, T6N, R86W; Sections 23, 24, 25, 26, 27, 34, 35 and 36 in TSn,
<br />R87W; and all of TSN, R86W with the exception of Sections 34, 35, and 36.
<br />The above-mentioned tracts of land are shown on USGS 7.5 minute Quadrangle maps of Rattlesnake Butte, Milner, and Cow
<br />Creek.
<br />Renew existing permit per 5 year permit term. This operator is not proposing to revise the permit or mine plan. This
<br />application proposes to renew an existing permit.
<br />In order for us to approve this renewal, we are required to make a finding that "the activities would not affect the continued
<br />existence of endangered or threatened species or result in the deswction or adverse modification of their critical habitats as
<br />determined under the Endangered Species Act of 1973...." We request your review and recommendation pursuant to this
<br />finding. Please advise us if you require additional information.
<br />In order Cor us to comply with regulatory time Frames, we request that comments be submitted to [he Division of Minerals and
<br />Geology at the above address by 5:00 p.m. on February 2, 1998. If no comments are received by this date, we will proceed
<br />on [he assumption that your agency has no concerns with or objections to the applicant's proposal.
<br />A copy of the renewal application is available for public inspection at the Rout County Courthouse, Boz 773598, Steamboat
<br />Springs, CO 80477, and at the Division office. For additional inFortnation, to provide written comments, or request an informal
