Lochhead <br />Executive Duedor <br />Michael B Long <br />Division Dveclor <br />The Division has completed our review of the Bear Mine 1 & 2's <br />phase I, II, and III bond release request. The field inspection <br />was conducted on August 3, 1994 and several issues were raised <br />during that inspection. Responses to those specific items were <br />submitted to the Division on September 2, 1994 and the responses <br />were satisfactory for the majority of the issues. <br />However, the responses left the issue of the old tipple area north <br />of highway 133 unresolved. In addition, a decision concerning the <br />"available material" below the No. 2 mine has been made. If this <br />material is not serving a stability function for the backfilled <br />portal area, it must be placed on the mine 1 portal fill where a <br />small portion of the highwall is exposed. This action would of <br />course restart the bond liability release period for those areas <br />disturbed. <br />Several other items of concern were also raised during the recent <br />review and these items are contained in the enclosed memo from <br />David Berry, as are the aforementioned items. If Bear can provide <br />satisfactory responses to these concerns, it appears that at least <br />some of the lands in question could be released. Since it will <br />obviously take some time to respond to the additional concerns <br />raised by the Division, Bear should submit a continuance letter to <br />keep the review process open. <br />If you have any questions, please contact Dave Berry or me. <br />Sin erel , <br />~ ~ ~~-- <br />Anthony J.
