The project is located adjacent to the <br />Colorado River within Section 22, Township 1 South, Range 1 East, <br />Mesa County, Colorado. <br />It appears from the information you have provided this <br />office that there is a potential for impacts to intermittent <br />drainages on the west end of the proposed expansion. In <br />accordance with Section 404 of the Clean Water Act, a Department <br />of the Army permit is required for any excavation or discharge <br />(including mechanized land clearing) of dredged or fill material <br />in waters of the United States. Within the context of Section <br />404, "waters of the United States" are defined as the territorial <br />seas; perennial and ephemeral streams; lakes, ponds, <br />impoundments; and wetlands. Federal law requires that <br />individual or entity proposing to excavate or discharge <br />waters of the United States obtain a Department of the <br />permit prior to commencing just work. <br />We have assigned number 199875144 to this project. <br />refer to this number if a Department of the Army permit <br />required for this project.
